A German data protection commissioner has called on Apple and Google to drop a Chinese AI company called DeepSeek from their app stores in the country over fears about data protection, according to a report of further crackdowns elsewhere.
The commissioner, Meike Kamp, said in a statement on Friday that she had sent the correspondence because DeepSeek “illegally transfers users’ personal data to China.”
The two American tech companies will now have to consider the request quickly and determine whether to block the app in Germany,
DeepSeek did not respond to a request for comment. Apple did not respond immediately to requests for comment.
DeepSeek stores a wide range of personal data, including requests to its AI programme or uploaded files, on computers in China, according to its own privacy policy.
“DeepSeek has so far failed to provide my agency with clear and convincing evidence that German users’ data is protected under Chinese law as well as it is under European law,” Kamp said.
“Chinese authorities have broad rights to access personal data in the possession of Chinese companies within their sphere of control,” she added.
The commissioner said she made that decision after giving DeepSeek an ultimatum back in May to comply with the rules around non-EU data transfers or else “voluntarily withdraw” its app. The request to DeepSeek was not granted, she added.
DeepSeek shocked the world in January with allegations it had created an AI model that competes with models from US companies such as the creators of ChatGPT, OpenAI, at a fraction of the price.
But it has faced criticism in the United States and Europe for its data privacy practices.
Italy stopped the app from being distributed through app stores there earlier this year, saying it didn’t know enough about how it handled personal data, while the Netherlands prohibited it on government devices.
Belgium has advised government officials to avoid DeepSeek. “Additional analyses are being conducted to assess the approach we are going to take,” a government spokesman said.
In Spain, the consumer rights group OCU called for an investigation into likely threats posed by DeepSeek, the government’s data protection agency, in February, yet no ban has taken effect.
The British government emphasized that “the use of DeepSeek remains a personal choice for members of the public.”
“Like all industries, we are also monitoring and assessing the impact any national security threats we face can have on our citizens, our data, our economic security and our businesses,” a spokesperson for Britain’s technology ministry said.
“If we get evidence of threats, we will take the necessary actions to protect our national security.”
U.S. lawmakers will also propose a bill that would prohibit U.S. executive agencies from using any AI models created in China.
